The facts set forth in Plaintiffs’ Complaint , including Appendices A and B thereto,[1] must be regarded as verities. (CP 1-102).

Plaintiffs are voters in Snohomish County whose unique votes have been diluted or nullified by widespread irregularities, including vote-switching[2] by Sequoia’s AVC Edge Electronic Voting System (touch-screen) voting machines. The Study co-authored by Plaintiff Lehto, “Election Irregularities in Snohomish County, Washington, General Election 2004,” demonstrates that the outcomes of votes cast by voters utilizing Sequoia touch-screen voting machines with no paper trail yielded results which differed wildly from the outcomes of votes by voters using paper ballots.[3]
